By signing up to the Burneston Dental Care Plan, you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by them.
“You” refers to any patient applying for acceptance onto our Dental Plan.
“We, “Our” or “Us” refers to Burneston House Dental Surgery Ltd at 44 Epsom Road, Guildford, Surrey, GU1 3LF (trading as Burneston Dental). Telephone number – 01483 573 630
Conditions for acceptance
- It is a condition to acceptance onto our Burneston Dental Care Plan (“the Plan”) that all patients have good standard of dental health before being accepted onto the Plan. New patients shall undergo an initial dental examination with one of our dentists to determine their general dental health. If our dentists advise that you require dental treatments to bring your dental health up to the standard required for acceptance onto the Plan, the dentist shall inform you of the treatment required and the charges applicable to those treatments. Existing Patients who meet the standards required for acceptance onto the Plan will need to discuss and agree with our dentists the appropriate Plan for their needs.
About the Burneston Dental Care Plan
- We offer a range of variants of the Plan to which these Terms and Conditions apply and the details of the specific variant of the Plan will be discussed and agreed with you prior to entering into the relevant Plan contract with us.
- The Plan is a scheme to provide preventative dental treatment over a twelve (12) month period (the “Plan Period”) which runs from the date of commencement (as described in conditions 4 and 5) and to provide additional discounts and / or benefits to plan members as stated in the current Burneston Dental Care Plan Leaflet, reflected online (Burneston Dental Care Plan – Burneston Dental Practice). A new twelve (12) month Plan Period begins on the expiry of the previous twelve (12) Plan Period.
Commencement and cooling-off period/cancellation
- The Plan is a contract which will commence on your entering into the Plan contract with us to which these Terms and Conditions apply and will continue until terminated or cancelled in accordance with these Terms and Conditions. Existing Plan contracts entered into prior to 1st July 2024 commenced on your entering into a Direct Debit mandate with us.
- If you wish to enter into the Plan contract with Burneston Dental and your dental health meets our requirements for acceptance onto the Plan, the contract will be concluded by your completing the Plan contract (previously the direct debit mandate) in person at the Burneston Dental premises. . We will email you to confirm the date of commencement of the Plan contract.
- Save as set out in Condition 7, you are entitled to the benefits of the Plan from the date of commencement and in accordance with each Plan Period until the Plan is terminated by either party in accordance with these Terms and Conditions.
- You have a fourteen (14) day cooling-off period from the date you sign the Plan contract in which to cancel your membership of the Burneston Dental Care Plan. If you cancel within this 14-day cooling-off period any contribution you have paid to the Plan will be refunded in full provided you have not already benefited from any of the benefits available under the Plan. If you have already benefitted from any of the benefits available under the Plan or received any services under the Plan during the 14 day cancellation period, we will make a proportionate charge for the services or benefits received. You will not be permitted to book any appointment or take advantage of any of the Plan benefits until after the completed direct debit mandate has been returned to us.
- No refunds will be given after the fourteen (14) day cooling-off period. Please ensure you make use of the Plan and visit us for your allocated appointments within the specified 12 month Plan Period.
Plan benefit conditions, payment and deposits
- Burneston Dental will send you complimentary reminders for Plan appointments, but it is up to you to make sure that you utilise the Plan benefits in the twelve (12) month Plan Period. If you do not attend or take advantage of the Pan appointments/benefits, in the twelve (12) month Plan Period you will not be entitled to any credit or refund.
- Plan benefits in a twelve (12) month Plan Period do not carry over into any subsequent twelve (12) month Plan Period if unused.
- Burneston Dental are entitled to refuse you access to Plan benefits or appointments if there is a balance outstanding on your account. Any outstanding balance will need to be settled in full before you can book appointments.
- You can request to take a payment holiday provided this is agreed with Burneston Dental prior to the taking of the payment holiday. Payment holidays are at the discretion of Burneston Dental and will be assessed by Burneston Dental on a case by case basis. During a payment holiday you will not be entitled to receive any of the benefits/services under the Plan and any requested treatments will be undertaken at our standard fees (Fee List – Burneston Dental Practice).
- Payment will be collected by direct debit. If you are a new Plan contract patient. you must complete the direct debit mandate either at the time of signing the Plan contract or by returning the same to us either in person or by email within 1 week of signing the Plan contract. If you fail to compete and return the direct debit mandate or if you cancel or amend your direct debit or have insufficient funds we may, at our sole discretion, terminate your membership of the Plan as detailed below. You agree to pay all fees on time.
- If we are unable to collect your monthly fee for any reason, we will contact you to collect any outstanding fees. Such outstanding fees may be collected by direct debit or paid to us directly by cash or card.
- Our standard policies governing failed appointments, cancellations, short notice and fail to attend charges apply (Policies – Burneston Dental Practice) (the “Policies”).
- You may be required to pay a deposit prior to receiving any treatment.
Plan Discounts
- You must make full and prompt payment of our monthly fees to be entitled and eligible to receive the offered discounts.
- Save as set out in these terms and conditions.being a member of the Plan entitles you to receive up to 10% discount on all of the treatments carried out by your dentist at Burneston Dental. (Some exclusions apply. Please see website (Fee List – Burneston Dental Practice) or practice leaflet for details).
- The 10% treatment discount cannot be used in conjunction with any other promotion offered by Burneston Dental.
Plan charges
- The Plan requires payment of a monthly fee and this is set out in the Burneston Dental Care Plan Leaflet, reflected online (Burneston Dental Care Plan – Burneston Dental Practice).
- Our Plan fees are reviewed on an annual basis and we reserve the right to increase these fees by giving you at least forty-five (45) days’ prior written notice.
- Burneston Dental is responsible for processing your Direct Debit payments for the Plan.
Termination
- If you default on two successive payments, we will notify you that your membership of the Plan has been terminated. If your membership of the Plan is terminated, Plan cover will cease from the date of the first failed payment and you would be charged for any services received from the date of the first failed payment at our standard fee prices (Fee List – Burneston Dental Practice).
- If you are removed from the Plan by termination by either party, any outstanding treatments not carried out will be charged at the full price of the original treatment cost.
- Following the initial cooling-off period, you may at any time terminate your membership of the Plan by giving us thirty (30) days’ prior notice by email or post. We will confirm receipt of your termination by email or post.
- If your membership of the Plan is cancelled or terminated by either Party, any outstanding treatment plan that has been estimated utilising the 10% discount benefit will be re-calculated and a new treatment plan will be issued to you detailing the full cost of the treatment. With respect to any treatment which is underway but not yet complete, this would be recalculated and charged at the full cost of the treatment.
- If you terminate the Burneston Plan contract under condition 25, no refund will be payable. Burneston may, in its absolute sole discretion, provide a partial refund in exceptional circumstances and on a case by case basis.
Disputes
- Any disputes arising under our contract with you shall be handled in accordance with our complaints procedure which can be found on our website: Policies – Burneston Dental Practice).
- If we are unable to resolve your complaint, you can forward your complaint to the Dental Complaints Service (www.dentalcomplaints.org.uk).
General
- Contract – Your contract with us comprises these Terms and Conditions and the applicable Plan you have agreed with us.
- Variations to Terms and Conditions/Plan – Burneston Dental reserve the right to vary or make changes to the Plan and these Terms and Conditions, with such changes taking effect after giving you at least forty-five (45) days’ prior notice of any such proposed changes and the date they will take effect. If you wish to terminate your contract with us prior to the changes taking effect, you would need to notify us of your termination in accordance with condition 25.
- Law and Jurisdiction – The Plan, these terms and conditions and our Policies shall be governed by and construed in accordance with the laws of England and Wales and will be subject to the exclusive jurisdiction of the English Courts.
- Copyright – You may not post, distribute or reproduce any copyrighted material, trademarks, or other proprietary information without first obtaining the permission of Burneston Dental.
- Notices – All notices given by Burneston Dental to you under these Terms and Conditions will be sent by email to the email address you supply to us or by post to your last known address. All notices given by you to Burneston Dental must be sent by email to info@burnestondental.com or post to Burneston Dental, 44 Epsom Road, Guildford, Surrey, GU1 3LF. All notices sent by post will be deemed received two working days after it was posted.

- Consent – Some treatments require you to provide written consent to ensure that we have explained the treatment, aftercare and any risk to you before such treatments are carried out. These consent requests are included in our written treatment plans This is to ensure you are in a position to make an informed decision before agreeing to treatment.
- Third Party Rights – A person who is not a party to this contract has no rights under the Contracts (Right of Third Parties) Act 1999 to enforce any of these Terms and Conditions or the provisions of the Policies.
